MEETING MINUTES
Commissioners Present: Chairman Stephen Smith, Steven LaBranche Linda Haspel and Fred Rollinson.
Commissioners Not Present: Michael Harnett and Vivien Cook.
Also Present: Jason Ellis of JC Ellis Design, Tim Brady of East Cape Engineering, Sam Southworth, Patricia Crow of Hadley Crow Studio.
6:04PM Stephen Smith opened the meeting
Request for Amended Order of Conditions filed by Adam Saffer DEP SE 19-1485 Applicant proposes deck material changes for decks for DEP SE 19-1485 for garage addition, pervious driveway, reconstructed retaining wall and outdoor shower, walkway, deck extension, and second floor deck addition at property located at 20 Nickerson Road, Map 14, Parcel 122.
Stephen Smith announced the applicant requests a continuance due to the commission receiving 22 pages of new information. Stephen Smith also noted the push was because of cost, and the 22 pages will enlighten and the commission should look into the information seriously. They are requesting the use of PVC and pressure treated wood.
Fred Rollinson MOVED to continue to February 12, 2013, Steven LaBranche SECONDED.

Continuation of Notice of Intent John Cannon and Diane Lim. Applicant proposes well installation, and deck construction associated with house construction at property located at 65 & 55 Piper Lane, Map 12, Parcel 265 & 266.
Jason Ellis explained they are upgrading the well which has older 2” well they propose to install a 4” well and a portable well and water line will be trenched to the house.
Jeff Thibodeau explained the project NHESP review shows no taking requested a limit of grading, suggested staging and storage areas should be up near road and no mitigation is proposed for the deck. Jason Ellis responded that the trenching from the septic line, the over dig for the foundation, and the sono-tubes for the deck will be addressed. He continued to say there is no intention for tree removal in the buffer zone and the well has to go in first and house may not be constructed for a year or two.
Linda Haspel asked about the existing dwelling.
Jason Ellis responded only interior work on existing house and the commission could condition demolition debris on the inside of the house. The debris removal would be done by hand or in a wheel barrow.
Jeff Thibodeau noted it is beneficial for a work protocol and should be part of every project and they need amended plan. Jason Ellis said he will work out construction protocol with Jeff and wants to move the project.

Continuation of Request for Amended Order of Conditions filed by Ross Bierkan. Applicant proposes new planting list, tree removal, installation of stone patio, walkways, expanded driveway and dog pen for DEP SE 19-1419 for demolition and construction of new dwelling with associated site improvements at property located at 225 Sparrow Road, Map 04, Parcel 190.
Tim Brady referenced the proposed driveway expansion proposed a planted parking area where they would install honeycomb pavers planted with conservation grass mix between. Tim Brady continued to say the hardening mix will be removed in the entire driveway area, they reduced the patio size they have expanded planting area they proposes a stone patio on a gravel bed directly on ¾ gravel over sand. They have increased planting sizes in areas three and four. They are adding 55 shrubs and 40 trees and removing 40 trees that are dead, dying or damaged.
Jeff Thibodeau said his concern was if all the proposed plantings could fit on the site. Tim Brady said they are proposing conservation grass mix in area six and trees will be flush cut with stumps left there and no irrigation. Stephen Smith said the conservation grass mix will not be mowed. Sam Southworth said they propose New England wetland mix. And there was concern the species in the mix would be too tall. Linda Haspel said the commission stretched to approve the house and they keep coming back expanding it. Tim Brady noted they did discuss the stairway at the first meeting it is not a new topic. The patio is new, they think they have approved the planting. They are improving conditions in areas 1, 3, 4, 7, 8 and they will make the area of the driveway as pervious as possible. Stephen Smith said that though the
project involves the entire lot, the habitat conditions will improve with the no mow zone.

Continuation of Notice of Intent filed by Gregory and Julie Douglas. Applicant proposes installation of a rock revetment and beach access stairway at property located at 325 Shurtleff Road, Map 07, Parcel 177.
Tim Brady said they will install sand drift fence from the revetment to the property line and they added a 4’ wide stairway and changed annual nourishment to 160 yards. Jeff Thibodeau said a draft order of conditions was prepared and noted condition #46. Stephen Smith requested pictures to be taken upon completion.
Tim Brady was unsure of the last line in the condition requiring the applicant to return to the Conservation Commission instead of requiring them to return the next year.
Linda Haspel said they have to consider the abutters.

Continuation of Notice of Intent filed by Sara Nelson. Applicant proposes vista pruning and removal of two trees, stone pathways and stone retaining wall and invasive species removal at property located at 325 Goody Hallet Drive, Map 20, Parcel 034.
Patricia Crow informed the commission the north property line was staked and Ryder and Wilcox determined the low area is not in the ACEC. Jeff Thibodeau said he was not sure what the basis was for determining the low area. Stephen Smith said how they have interpreted the ACEC in the past as there can be no fill or grading in the ACEC. Stephen Smith also said it is proposed to remove a tree at the 10’ contour and typically the commission requires two trees to be replanted as mitigation. He also suggested they establish a 10-12 degree view corridor and the pear tree to be mitigated for 1:1 from the Eastham approved native plant list. It was determined no work to occur within the ACEC and any natural growth in the ACEC cannot be altered.

Other Discussion
Jeff Thibodeau said they have had a number of administrative reviews for tree cutting Cicero Property at 45 Bayview Road were authorized to do the work involving 40 trees being altered.
Stephen Smith said he had stopped job and was looking for the Order of Conditions regarding the cedar trees and they went tree by tree. Steven LaBranche noted that in Orleans every sub-contractor has to sign a form saying they have read the Order of Conditions.Stephen Smith suggested they adopt the form as a regulation, so the sub contractors are also held responsible.

Pressure Treated Lumber Discussion
Stephen Smith said air dried lumber has good longevity and it can be done and he suggested the commission to think about how to craft no pressure treated wood into a regulation. Fred Rollinson wondered if the commission is going overboard on the requirement for no pressure treated wood as it is fine to use for gardens.
Stephen Smith responded that most of the new pressure treated wood is from copper, which is fine for humans however copper for marine life is detrimental
The commission decided they need to come up with a regulation.
